There have been several busts and lawsuits in Louisiana lately, mostly focusing on for-money games in bars which have been taking off there.

Texas Hold 'Em tournaments have become popular at many bars in and around Lafayette in recent months, but Alcohol and Tobacco Control Commissioner Murphy Painter is planning to send out cease and desist orders to bar owners about the games soon, according to the Associated Press. Painter said he plans to start "seriously investigating" poker tournaments this week.

Bottom line...

If players are risking money for a chance at profit (i.e. gambling) and a business establishment is hosting it (simply providing space, nothing more), it is still an illegal gambling enterprise because the bar would be profiting off the gambling through beer and food sales.

I am the lawyer representing the bars that sued the Louisiana Alcohol and Tobacco Control in Baton Rouge. My clients have continued to hold their tournaments on Tuesdays, Thursdays and Saturdays since the Court hearing. The ATC has not bothered us at all, but last week raided a bar in Ascension Parish after an undercover investigation alleging that the tournament director was skimming the tournament money. We do not support this as it gives a bad name to those places conducting the games right. Our position is if the ATC thought they were right, they would have shut us down. They didn't like the bad press they were getting and knew we wouldn't cease and desist voluntarily. They risk a lawsuit over false arrest if they mess with my clients.
